Union Square Hospitality Group, LLC and its affiliates, subsidiaries and restaurants (collectively, “USHG”, “we”, “us” or “our”) are concerned about privacy issues and want you to be familiar with how we collect, use and disclose information. This privacy policy (and as amended from time to time as posted on our website here, “Privacy Policy”) describes our practices in connection with collecting, using, maintaining, protecting, disclosing, retaining, and transferring information that we collect through our ushg.com and other websites operated by us from which you are accessing this Privacy Policy (the “Websites”), by purchasing our products online (“Products”) or our services online, through our social media pages that we control from which you are accessing this Privacy Policy (collectively, our “Social Media Pages”), through HTML-formatted email messages that we send to you that link to this Privacy Policy (collectively, including the Websites, and our Social Media Pages, the “Services”), when you interact with our digital services (including using our WiFi), and when you contact us.

By interacting with our digital services, visiting our Website or purchasing our Products or Services in any manner, you acknowledge that you accept the terms, practices and policies described in this Privacy Policy (and as updated from time to time), and you hereby consent that we may collect, use, and share your information as described herein. If you do not agree with our policies and practices, your choice is not to use our Website or our Services. Your use of the Website and our Services is at all times subject to our Terms of Use (available here and as updated from time to time (the “Terms”)), which incorporates this Privacy Policy. Any capitalized terms we use in this Privacy Policy without defining them have the definitions given to them in the Terms.

Personal Information does not include information that has been altered or aggregated so that it no longer reasonably identifies you. 

We may use a third-party payment service to process payments made through the Services. We do not collect or store your full credit card information, though we may collect tokenized payment information. If you wish to make a payment through the Services, your Personal Information may be collected by such third party and not by us and will be subject to the third party’s privacy policy, rather than this Privacy Policy. We have no control over, and are not responsible for, this third party’s collection, use and disclosure of your Personal Information. 

 Individuals under the Age of 16  

We do not knowingly collect, solicit or maintain Personal Information from anyone under the age of sixteen or knowingly allow such persons to register for our Services. If you are under the age of 16, please do not send any Personal Information about yourself (such as your name, address, telephone number, or email address) to us.  

Changes to Our Privacy Policy 

As we improve our Website, Services, and business practices, we may need to change this Privacy Policy from time to time as well. Our current Privacy Policy will always be on our Website here and any updates will be effective upon posting. You are responsible for periodically checking our Website for updates. If you use the Website, purchase products, or use our Services after any changes to the Privacy Policy have been posted, that means you agree to the new Privacy Policy, including all of the changes. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is collected.

  • Information that you provide by filling in webforms on our Website or other platforms. This includes information provided purchasing our Products or Services, subscribing to our communications, requesting information from us, interacting with customer support or service, interacting with our digital services (including WiFi), reporting a problem with our Website, products, or Services, or otherwise communicating with us.  

  • Information you provide when you visit our restaurants, place an order over the phone, or contact us.  

  • Records and copies of your correspondence (including email addresses), if you contact us. 

  • Event registrations. 

  • Your responses to surveys that we or our service providers might ask you to complete for research purposes. 

  • Communications with our customer service representatives  

  • Responses to employment opportunities; and 

  • Information provided via loyalty/rewards programs.

How We May Use Personal Information We may use Personal Information:  

  • To present our Website and its contents to you.  

  • To provide you with the Products, Services, or information that you have requested and respond to your questions on products or Services and information on new Products and Services, discounts, special promotions or upcoming events, and features or offers that we believe will be of interest to you.  

  • To respond to your inquiries and fulfill your requests, such as to send you newsletters.  

  • To send administrative information to you, for example, information regarding the Services and changes to our terms, conditions, and policies.  To complete and fulfill your purchase or sign you up for events, for example, to process your payments, have your order delivered to you, communicate with you regarding your purchase or reservation and provide you with related customer service. 

  • To send you marketing communications that we believe may be of interest to you.  

  • To allow you to participate in sweepstakes, contests and similar promotions and to administer these activities. Some of these activities have additional rules, which could contain additional information about how we use and disclose your Personal Information, so we suggest that you read these rules carefully.  

  • For our business purposes, such as data analysis, audits, fraud monitoring and prevention, developing new products, enhancing, improving or modifying our Services, identifying usage trends, accounting, recordkeeping, determining the effectiveness of our promotional campaigns and operating and expanding our business activities.

How Personal Information May Be Disclosed  

Unless stated otherwise below, we may disclose for our business purposes any of the Personal Information we collect to: 

  • Our third-party service providers who provide services such as website hosting, data analysis, payment processing, order fulfillment, information technology and related infrastructure provision, customer service, identity management, consulting services, marketing and survey services, advertising services, email delivery, auditing and other similar services.  

  • Third-party sponsors of sweepstakes, contests and similar promotions.  

  • To your friends associated with your social media account, to other website users and to your social media account provider, in connection with your social sharing activity, such as if you connect your social media account to your Services account or log into your Services account from your social media account. By connecting your Services account and your social media account you authorize us to share information with your social media account provider and you understand that the use of the information we share will be governed by the social media site’s privacy policy. If you do not want your Personal Information shared with other users or with your social media account provider, please do not connect your social media account with your Services account and do not participate in social sharing on the Services. 

  • To a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings).  

  • As we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to lawful requests from government authorities or third parties; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain. 

 If we collect your phone number through SMS consent, we will not sell it to, rent it to or share it with third parties for marketing purposes.  

We may share information that does not reasonably identify you with any third party for any purpose.  

Cookies and Other Automated Data Collection Technologies 

When you visit or interact with our Services, we may obtain certain information by automated means. We use a variety of technologies to collect this information, such as browser cookies, flash cookies, web beacons, mobile device identifiers, and server logs. We collect information about your online activities over time and across different websites, apps and devices, including those websites and apps of third parties. We also work with third parties, such as ad networks and other service providers, that collect information about your online activities in this way. 

These technologies help us (1) remember your preferences; (2) understand how you use and interact with our Services and third-party digital services; (3) personalize the content you see on our Services; (4) understand the effectiveness of our communications; (5) identify, diagnose and resolve technical issues; (6) deliver targeted advertising; and (7) otherwise manage and enhance our Services and offerings.  

We and certain third parties display targeted advertising using information gathered about you over time and across devices and third-party websites, apps and platforms. Targeted advertising includes ads served to you on other websites and ads we think are relevant based on your online activities. These ads might be served on websites or on mobile apps. They might also be served in emails or other ways. We might serve these ads, or third parties may serve ads. They might be about our products or other companies’ products.

Do Not Track  

Some browsers have “do not track” features that allow you to tell a website not to track you. These features are not all uniform. We do not currently respond to such “do not track” signals from browsers. If you block cookies, certain features on our sites may not work. If you block or reject cookies, not all of the tracking described here will stop. Options you select are browser and device specific.  

Security  

We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration and disclosure. However, as no Internet transmission is 100% secure, we cannot guarantee the security of your Personal Information

If you no longer wish to receive marketing-related emails from us, you may opt-out from such messages by following the instructions contained in each such email. If you would like to review, correct, update, or delete the Personal Information that you have provided to us, you may contact us (see below).

This section describes our practices regarding the collection, use, and disclosure of the personal information of California residents, describes the rights of California residents under the California Privacy Rights Act of 2020 (“CPRA”), and explains how California residents may contact us to exercise those rights. Right to Request Deletion Y 

ou have the right to request that we delete any Personal Information about you which we have collected from you. If it is necessary for us to maintain your Personal Information for certain purposes, we are not required to comply with your deletion request. If we determine that we will not delete your Personal Information when you request us to do so, we will inform you and tell you why we are not deleting it. 

 Right to Opt-Out of Sale or Sharing of Personal Information  

We do not sell your Personal Information for monetary consideration. However, we may use third-party cookies for analytics and/or targeted advertising purposes. The collection of data through certain third-party cookies and sharing of that data with our third party website analytics and digital advertising service providers for our analytics or targeting advertising purposes may be considered a “sale” and is considered “sharing” under the CPRA. Right to Correct Inaccurate Personal Information  

You have the right to request that we correct inaccurate Personal Information, taking into account the nature of the Personal Information and the purposes of the processing of the Personal Information.  

Right to Limit Use and Disclosure of Sensitive Personal Information  

We do not currently collect Sensitive Personal Information (as defined by the CPRA).  

Non-Discrimination  

You have the right not to be discriminated against for exercising any of your aforementioned rights.  

How to Submit a Request  

To exercise the rights described above, you must submit a verifiable request to us. You can do so by visiting our “Do Not Sell or Share My Personal Information” page here

 If you maintain an account with us, we will verify your identity for a request through the normal account authentication process, meaning you will need to sign on with your username and password. 

 If you do not maintain an account with us, when you submit a verifiable request you will be asked to provide certain information to help us verify your identity. The information we ask you to provide to initiate a request may differ depending upon the type of request, the type, sensitivity and value of the Personal Information that is the subject of the request, and the risk of harm to you that may occur as a result of unauthorized access or deletion, among other factors.  

You may make a verifiable request on behalf of your minor child. You may also designate an authorized agent to make a request on your behalf by providing the agent with signed written permission to do so.  

If we cannot verify your identity or authority to make the request, we will not be able to comply with your request. We will inform you if we cannot verify your identity or authority. We will only use Personal Information provided in a verifiable request to verify the requestor’s identity or authority to make the request.  

If you are an employee or constituent of one of our Customers, please submit your requests to exercise your rights directly to such Customer.  

California “Shine the Light” Law 

 California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of the Services that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. Although we do not currently disclose Personal Information to third parties for such purposes, to make a request, please send an email to info@ushg.com
